A former America’s Got Talent contestant has filed a lawsuit against the actor and his management company, alleging pressure, harassment, and psychological harm.

A lawsuit has been filed against Will Smith, in which musician Brian King Joseph accuses the actor and rapper of sexual harassment, wrongful termination, and creating a hostile work environment. The documents were obtained by Variety.

Who Filed the Lawsuit and Against Whom?

The plaintiff is violinist Brian King Joseph, a former participant on America’s Got Talent. The defendants in the case are Will Smith himself and his management company, Treyball Studios.

According to the lawsuit, Joseph alleges that during the period of their collaboration, he was subjected to pressure and unwanted sexual attention from the artist.

Start of Collaboration and the 2025 Tour

The court documents state that in November 2024, Joseph was hired by Smith to perform in San Diego. Later, the musician was invited to join the concert tour Based on a True Story, which took place in the spring of 2025.

It was during this tour, the plaintiff claims, that incidents he considers harassment began to occur. The lawsuit alleges that Smith displayed "predatory behavior" and sought personal closeness, making statements about a "special connection" that he supposedly did not have with others.

The Las Vegas Incident

The key episode that led to the musician’s termination occurred in March 2025 in Las Vegas. Joseph reported that after his bag containing his hotel room key disappeared and later reappeared, he discovered signs of unauthorized entry in his room.

According to him, the room contained wet wipes, a prescription bottle for medication used to treat HIV complications, issued in another person’s name, and a note with the text:

"Brian, I’ll be back by 5:30 at the latest, just us," accompanied by a drawn heart and the signature "Stone F."

The musician interpreted the incident as a sexual threat and a severe violation of personal boundaries.

Response and Termination

After the incident, Joseph reported it to the hotel security, informed Will Smith’s representatives, and filed a police report. However, according to the lawsuit, several days later, the artist’s manager "shamed" the musician for the situation and informed him of his termination.

According to the plaintiff’s version, he was also given to understand that the incident was fabricated or exaggerated, which he perceives as additional pressure.

Plaintiff’s Demands and Consequences

Joseph claims that the events caused him serious psychological harm, including the development of post-traumatic stress disorder, as well as financial losses due to losing his job.

In the lawsuit, he seeks compensation for sexual harassment, wrongful termination, and workplace pressure. The final amount of damages is to be determined by a jury.
